Terms & Conditions
§ 1 Scope
These Terms and Conditions apply to all contracts for the purchase of digital licenses for the language learning software "RealPortuguese" between Kai Hillebrand ("Provider") and the customer ("Buyer").
§ 2 Subject Matter
The subject of the contract is the granting of a time-limited or permanent right to use the language learning software "RealPortuguese" in the form of a license key and the provision of the software for download. The license key entitles the use on up to two devices simultaneously.
§ 3 Conclusion of Contract
By clicking the "Order now" button, the buyer submits a binding offer to purchase the license. The contract is concluded upon confirmation of payment by the payment service provider Paddle.
§ 4 Prices and Payment Terms
All prices are in Euro (€) including statutory VAT. Payment is processed exclusively through Paddle. The purchase price is due immediately.
§ 5 Right of Withdrawal
In accordance with applicable EU law, there is no right of withdrawal for contracts for the supply of digital content in non-tangible form (software) if the execution of the contract has begun with the consumer's prior express consent. By purchasing, the buyer agrees to the immediate start of the service.
§ 6 Rights of Use
The buyer receives a simple, non-transferable right to use the software for personal, non-commercial purposes. The license key must not be shared with third parties.
§ 7 Update Support
Update support is included in the purchase price and is valid for 12 months from the date of purchase. After expiration, the last downloaded version can continue to be used. Extension of update support is available.
§ 8 Warranty
The provider warrants that the software at the time of provision substantially corresponds to the description. The warranty period for consumers is two years from the date of purchase.
§ 9 Limitation of Liability
The provider is liable without limitation for intent and gross negligence, for injury to life, body and health. Otherwise, liability is limited to compensation for typical and foreseeable damages.
§ 10 Governing Law
The law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
